Purchase of one of our tours or Services is acceptance of the following:

The following Customer Service Agreement applies for purchases of travel made on this website with Art In Voyage, divisions of MGT Ventures Inc. (thereafter referred at THE TRAVEL COMPANY). Purchase of any travel services and payment of related invoices is acceptance of the following terms and conditions.

CUSTOMER SERVICE AGREEMENT / PAYMENT POLICY

Payments
Deposits and payments must be made upon reservation and acceptance of the booking agreement by the customer. A non-refundable minimum deposit of $250.00 (see below) is required on all pre-customized tours & Vacation rentals. The booking agreement states the required deposit for all other tours.
Each of our reservations are associated to a booking agreement. That booking agreement takes precedent over the following general payment policy. The policy below is applicable to Escorted tours and packages available on our website. All customized tours (by customized we mean tours and packages that our consultants have designed and created for your specific needs) are subject to booking agreement payment policy.

Upon reservation: A minimum deposit of $250.00 per person unless otherwise noted in booking agreement/proposal. This deposit will be applied towards the balance.
60-75 days prior to departure: Balance must be paid in full unless otherwise stated in booking agreement
For reservations made less than 60 days prior to departure date: Payment in full required.
AIR FARES CHARGED TO YOUR CREDIT CARD DIRECTLY BY THE AIRLINE. THE TRAVEL COMPANY DOES NOT PROCESS PAYMENTS FOR AIR FARES.

 

All rates are guaranteed upon deposit.

 

EXCHANGE RATE CLAUSE:

 

Should EXCHANGE RATE fluctuate more than 5% between payment of the deposit and payment of the final balance, a re-adjustment in price of 5% will occur.

Travel agents & FAM trips:

 

Travel agents must be registered with THE TRAVEL COMPANY to be able to sell tours and packages. Travel agents must be accredited and in good standing by one of the main 2 consortiums: IATA or CLIA. Agents not accredited shall not be entitled to industry discounts, Leaning & FAM trips offered by THE TRAVEL COMPANY. Agents found to be using fraudulent identification forms or accreditations will be responsible for paying the difference between published and discounted rates. THE TRAVEL COMPANY also reserves the right to refuse service to any agents not accredited.

 

Fam Trips may be postponed up to 30 days prior to scheduled departure. In such cases, THE TRAVEL COMPANY would re-schedule such trips at a date not to exceed 90 days from the original scheduled departure. In such cases, THE TRAVEL COMPANY would provide in-house credit to be applied to the new dates. Should agents be unable to attend at the new dates, agents would have the right to select another FAM TRIP or receive 15% OFF regular departure and tours. No refunds would be issued on postponed FAM TRIPS unless covered by purchased travel insurance.

Revision Fees:
A handling fee of $75.00 per transaction will be assessed for any change or revision made to a reservation at less than 30 days. A change of departure date within 60 days of departure will be treated as a cancellation and cancellation charges will apply.
Transfers and Cancellations: Cancellation Charges
If you have not purchased waivers, and you need to transfer or cancel for any reason prior to tour departure, the cancellation fees will be as follows for tours/packages. Exception to this general rule is made when noted in the booking agreement/proposal

Cancellation conditions stipulated in the reservation agreement, page 2 takes precedent over the following. Unless otherwise noted on page 2, the following applies:

  • More than 120 days prior to departure:                        Deposit retained
  • 120-60 Days:                                                                25% of the tour cost
  • 59-30 Days:                                                                  50% of the tour cost
  • 29-Day of departure and below:                                   100% of total price

Note: Upon cancellation of transportation or travel services where you, the customer, are not at fault and have not cancelled in violation of the terms and conditions above, you will be refunded based on the terms and conditions set forth by each individual service provider used for your travel arrangements. Such refunds may take up to 10 (ten) weeks.

THE TRAVEL COMPANY can assume no responsibility for and cannot be held liable for any wrongful, negligent or unauthorized acts or omissions of any travel agent or travel agency other than that of THE TRAVEL COMPANY itself, and its own employees.

The waiver fees do not cover any single supplement charges which arise from an individual’s traveling companion electing to cancel for any reason prior to departure. In this case, the single supplement will be deducted from the refund of the person who cancels. Division of this charge between the two passengers involved is solely their responsibility. If insufficient funds are deducted from the canceling client, the traveling client will be charged the remaining portion of the single supplement. The Land and Air waiver fee does not include any medical or baggage coverage.

To request a refund under the Cancellation and Unused Services Land and Air Waiver, please send any unused airlines tickets, an explanation for the cancellation (optional), and a written request to: MGT Ventures Inc Attn: Customer Service Dept., 2711 Centerville Rd, suite 400, Wilmington, DE 19808. If cancellation occurs prior to departure, contact our Reservations Department. When a client cancels prior to departure, any refunds are processed through the Reservations agent. Agent commissions are not protected if cancellation occurs prior to departure. Please call our Customer Service Department at 1-888-610-8687 with any customer care questions.

When purchasing pre and post night accommodations, including optional extensions, the number of days will be added to the total number of tour days, and may subsequently alter your waiver fees. Please confirm with your reservation agent at time of Reservations.

The Air Waiver fee can only apply to individuals who have purchased air through THE TRAVEL COMPANY

Additional Services: Consumer Protection Plans

THE TRAVEL COMPANY is fully bounded and insured.

In addition, THE TRAVEL COMPANY recommends CSA TRAVEL PROTECTION to all of its clients.

Departure Taxes

When purchasing air transportation from THE TRAVEL COMPANY, various international departure and arrival fees are included in the airfare. ONLY PORT CHARGES for cruises are not included. These will be added to your final invoice. Should these charges be including in your quote, it will be noted on your booking agreement/proposal.

Other taxes/fees are to be paid upon exiting the country in local currencies. Please refer to the appropriate tour itinerary for estimated taxes/fees. Rates are subject to change and those provided are simply an approximation of taxes and fees at the time of printing.

Explanation of Responsibilities and Tour Conditions for the Travel Company

Any person reserving or purchasing any product or service offered by THE TRAVEL COMPANY accepts the condition that THE TRAVEL COMPANY reserves to itself the exclusive right to change or cancel itineraries, hotels, and other tour components whenever it is deemed necessary. If this occurs, every effort will be made to offer alternate dates and/or programs.

Published times on itineraries are as accurate as possible but subject to change due to traffic, weather, mechanical and any other conditions beyond THE TRAVEL COMPANY’s control that prevent THE TRAVEL COMPANY from operating as scheduled. THE TRAVEL COMPANY expressly disclaims any liability for any damages that may be incurred for any changes, cancellations or delays on any itinerary provided by THE TRAVEL COMPANY due to weather, traffic or extraordinary circumstances.

All rates on foreign tours are subject to fluctuations of currency and may be changed when necessary without advance notice prior to deposit.

All rates published are per person as indicated and are based on double occupancy when only one rate is shown. Reservations will be accepted subject to availability at the time of a request and will be considered confirmed only upon receipt of the required deposit. Child rates are available. Please call for details. Child rates apply to children 5 to 17 years old sharing a room with 2 full paying adults.

THE TRAVEL COMPANY does not accept liability in the case of any passenger being denied boarding by any airline carrier due to the carrier’s over-booking of a flight. However, THE TRAVEL COMPANY will make every effort to ensure the passenger is offered an alternative and an associate will remain with the passenger until boarding is finalized (when possible).

All cancellation charges, fees and refunds for any tour/package are in effect as of the effective date as indicated on the back cover of our brochure(s) or on our website and supersede any other previously printed policies relating to these same charges.

-       Travelers Needing Special Assistance

In compliance with the American With Disabilities Act, THE TRAVEL COMPANY will make reasonable efforts to accommodate the special needs of tour participants. It is strongly recommended that persons requiring assistance be accompanied by a companion who is capable of and totally responsible for providing the assistance. Neither THE TRAVEL COMPANY personnel nor its suppliers may physically lift or assist clients onto transportation vehicles. Travelers needing special assistance for other than personal needs must inform THE TRAVEL COMPANY at the time of booking to determine what assistance may reasonably be made available by THE TRAVEL COMPANY. THE TRAVEL COMPANY regrets that it cannot provide special individual assistance to a tour member with special needs for walking, dining or other special needs.

-       Baggage Disclaimer

Although every effort is made to handle passengers’ luggage as carefully as possible, THE TRAVEL COMPANY is not responsible for and does not assume any liability or accept any claims for loss of or damage to luggage due to breakage, theft or wear and tear through hotel and group carrier handling. We that you have purchased adequate insurance to cover these eventualities. Check with your sales agent for low cost insurance to cover these risks.

-       Maps and Photos

Maps shown on tour pages are current at the time of printing and may not reflect actual tour routing should the tour change. Photos shown on tour pages are reflective of the area(s) visited, but may not be included in the actual tour itinerary.

-       General Disclaimer

In all matters relating to the making of arrangements for hotel and/or motel accommodations, sightseeing tours and services provided incidental thereto, entertainment, and transportation by air, railroad, motor bus, automobile, or steamship, THE TRAVEL COMPANY and its subsidiaries act only in the capacity of an agent for the airlines, hotels/motels, and other suppliers stated in the tour literature describing the services purchased.

Because of its status as an agent, and because it maintains no control over the personnel, equipment, or operations of these travel suppliers, THE TRAVEL COMPANY and its subsidiaries assume no responsibility for an cannot be held liable for any personal injury, property damage or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason of (1) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of any of these suppliers, (3) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise, of THE TRAVEL COMPANY

THE TRAVEL COMPANY may not be held responsible should the travelers disliked the country, places, the food and the climate while traveling on pre-customized tours. For all of our escorted tours, our travelers are briefed prior to departure. Should the traveler disagree with one or many options/activities on the trip, THE TRAVEL COMPANY will accept comments and remarks and do its best to accommodate the traveler to make the vacation as enjoyable as possible.

THE TRAVEL COMPANY , for all tours and packages involving villa or apartment rentals, will hold the travelers and renters responsible for any damages that incurred during their stay up to a reasonable point. The traveler will be able to request repair/replacement invoices and dispute any abusive charges as long as a counter-expertise is requested and paid for by the traveler. THE TRAVEL COMPANY &will debit the traveler’s card on file and hold funds until the dispute is being resolved. For cash paying customers, an invoice will be mailed with payment due within 30 days of receipt. Failure to dispute or comply may result in legal challenges, including finance charges of 25% APR.

FOR ALL VACATIONS INVOLVING A RENTAL (group or individual), TRAVELERS WILL BE ASK TO PROVIDE A VALID CREDIT CARD. THE TRAVEL COMPANY  MAY CHARGE A DEPOSIT UP TO $1,000 PER TRAVELING PARTY TO BE REFUNDED UPON RETURN.

THE TRAVEL COMPANY does not discriminate nor refuse service to anyone based on ethnicity, religion, sex, sexual preferences, or social category. However, it reserves the right to deny service to anyone should THE TRAVEL COMPANY associates judge our services and products inadequate for the customer. If such action is taken, the customer will be informed about the decision and will be refer to another agency. THE TRAVEL COMPANY also reserves the right to refuse service to anyone showing signs of violence. Our goal is to protect our travelers from any incident.

THE TRAVEL COMPANY reserves the right to withhold any refunds and to take legal actions should it become the victim of slandering, unjustified complaints, harassment. All matters shall be resolved amicably and all parties shall be given enough time to respond appropriately to complaints or refund request prior to any legal actions being taken. THE TRAVEL COMPANY understands consumer rights and consumer protection. It abides by Florida State laws and carries a bond through the Department of Agriculture and Consumer Services. Options to go after the bond should mediation fail to produce an acceptable resolution is available to all clients. This right will be waived should THE TRAVEL COMPANY be unfairly slandered though the use of bias and non accredited online websites.

PLEASE NOTE:

THE TRAVEL COMPANY organizes and supervises the making of many of our tours every year. Each one of these tours is designed with the assistance of suppliers and other travel agencies. For such tours, THE TRAVEL COMPANY assumes partial liability to the extent of its participation, including actions by its escort guides and other employees. Please ask one of our associates about these tours. THE TRAVEL COMPANY is also a reseller of escorted tours and cruises. For these specifics tours, the above-mentioned general disclaimer applies in addition to the one of the wholeseller or supplier
