• supplier conditions;

• payment terms;
• journey-specific terms.

Where there is a conflict regarding a travel purchase, the applicable Travel Agreement, Sales Terms or journey-specific conditions will control.

You may browse the Website regardless of age. However, you must be at least 18 years old and legally capable of entering into a contract to:

• create an account;
• submit a booking;
• purchase services;
• accept a Travel Agreement;
• provide information on behalf of another traveler.

Parents or legal guardians may provide information concerning minors who are traveling under their authority.

We aim to present accurate and useful information. However, travel information changes quickly.

Prices, availability, dates, accommodations, routes, inclusions, photographs, descriptions and itineraries may change or contain errors. Website content does not constitute a confirmed reservation or binding offer unless we expressly state otherwise in writing.

A reservation is not confirmed until Art In Voyage has:

• issued written confirmation;
• accepted any required agreement;
• received the required payment; and
• confirmed availability with the relevant suppliers.

We may correct obvious pricing, availability or content errors before confirming a transaction.

Certain Website features may require an account.

You are responsible for:

• providing accurate information;
• maintaining the confidentiality of your login credentials;
• restricting access to your account;
• notifying us promptly of suspected unauthorized access;
• ensuring information provided for you or your traveling companions is accurate.

You may not impersonate another person, create an account without authorization or use another person’s account.

We may suspend or restrict an account where reasonably necessary to protect travelers, Art In Voyage, our suppliers or the security of the Website.

Submitting an inquiry, wish list, saved journey, preference form or proposed itinerary does not create a booking or require Art In Voyage to provide services.

Travel recommendations are based on the information available when they are prepared. You remain responsible for reviewing all proposals, dates, names, passport information, inclusions and exclusions before confirming a journey.

When providing information about another person, you confirm that:

• you are authorized to provide it;
• the information is accurate;
• the person has received or has access to our Privacy Policy;
• you have obtained any consent required to provide sensitive information.

You must not submit another person’s passport, health or financial information without proper authority.

By communicating with us electronically, you consent to receive service-related communications electronically, including:

• inquiry responses
• proposals;
• account notices;
• booking confirmations;
• invoices;
• travel documents;
• operational updates;
• safety or emergency communications.

Promotional email and text-message communications are handled separately. You may unsubscribe from marketing messages without affecting essential booking or service communications.

The Website and its content—including its design, branding, text, photography, video, itineraries, journey concepts, graphics, databases, software and editorial materials—are protected by intellectual-property laws.

The technology platform that powers the Website—including all software, source code, databases, APIs, CRM, the AIV Team system, the TrueNorth app, workflow automations and any derivative works—is owned exclusively by AIV Labs, Inc. and is used by Art In Voyage, Inc. under an exclusive license.

You may view Website content for your personal, non-commercial use.

Unless we give prior written permission, you may not:

• reproduce or republish Website content;
• copy or commercially exploit an itinerary or journey concept;
• scrape or systematically extract Website data;
• modify or create derivative works;
• remove copyright or proprietary notices;
• use our branding, trademarks or trade dress;
• train an artificial-intelligence system using our protected content;

Nothing in these Terms transfers ownership of our intellectual property to you.

You grant Art In Voyage a limited, non-exclusive license to process that material only as reasonably necessary to:

• provide contracted services;

We will not publicly use private photographs, testimonials or personal travel stories for advertising without obtaining the required permission.

Publicly submitted reviews or comments may be displayed, moderated or removed. You must not submit content that is unlawful, defamatory, threatening, misleading, malicious or infringing.

• commit fraud or impersonation;

Liability arising from purchased travel services is governed by the applicable Travel Agreement and Sales Terms rather than this Website provision.

To the extent permitted by law, you agree to reimburse Art In Voyage for reasonable losses, liabilities and expenses caused by your intentional unlawful misuse of the Website, infringement of another person’s rights or material breach of these Terms.

This provision does not apply to ordinary consumer use or conduct caused by Art In Voyage.

We may suspend or terminate access where reasonably necessary because of:

• unlawful conduct;
• security threats;
• fraud;
• material violation of these Terms;
• misuse of an account;
• conduct that threatens our travelers, employees or suppliers.

Provisions relating to intellectual property, liability, disputes and privacy will survive termination where their nature requires it.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

Subject to mandatory consumer rights, disputes relating solely to use of the Website will be brought in the state or federal courts serving Orange County, Florida.

Nothing in these Terms deprives a consumer of mandatory rights, protections or legal remedies available under the laws of the consumer’s place of residence.

Before filing a claim, you and Art In Voyage agree to make a reasonable attempt to resolve the matter informally.

We may update these Terms to reflect changes in our Website, business practices or legal obligations.

The updated date will appear at the top of this page. Material changes affecting registered users may also be communicated through email or an account notice.

If a provision is held invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or modified only to the minimum extent required by law.

These Terms constitute the agreement governing use of the Website. They do not replace a Travel Agreement, Sales Terms, supplier conditions or other contract applicable to purchased services.
